13. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Tennessee, without regard to its conflict-of-law principles. Any dispute not subject to arbitration shall be resolved exclusively in the state or federal courts located in Franklin County, Tennessee, or the federal district with jurisdiction thereover.
14. Informal Dispute Resolution
Before initiating any formal dispute resolution, you agree to first contact us at contact@thepeptidecolumn.com and attempt to resolve the dispute informally for at least thirty (30) days. This informal resolution period is a prerequisite to any arbitration or legal proceeding.
15. Arbitration Clause
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any controversy or claim arising out of or relating to these Terms, or the breach thereof, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The seat of arbitration shall be within the State of Tennessee, or at the option of the parties, conducted virtually.
Arbitration Cost Provisions: If your claim is for $10,000 or less, the Company will pay all arbitration fees. For claims above $10,000, arbitration fees shall be allocated as determined by the AAA Consumer Arbitration Rules. Each party shall bear its own attorney's fees unless the arbitrator determines otherwise.
Small Claims Court Exception: Notwithstanding the above, either party may bring an individual action in a Tennessee small claims court of competent jurisdiction, if the claim qualifies.
YOU AGREE THAT ANY ARBITRATION SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator shall not have the power to preside over any form of representative or class proceeding.
16. Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST THE COMPANY. This waiver applies to claims of any kind, whether in contract, tort, or otherwise.
17. No Sale or Distribution of Drugs
The Company does not manufacture, compound, sell, distribute, or dispense any peptides, drugs, supplements, or pharmaceutical products. The Company is a media and education platform only. Nothing on the Website should be construed as an offer to sell or a solicitation to purchase any pharmaceutical product.
18. Modifications
We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting.
